Terms of Use — PayATH | ATH Móvil App for Shopify

These Terms of Use ("Terms") govern your access to and use of the PayATH Shopify app and the payath.app website (collectively, the "Service"), operated by Musa Studios ("we," "us," or "our"). By installing or using the Service you agree to these Terms.

1. Description of Service

PayATH is a Shopify app that allows merchants to display ATH Móvil Business payment instructions — including QR codes and customizable text — on their Shopify store's checkout thank-you page and cart page. PayATH is a display-only tool and does not process, initiate, or confirm payments. All payment transactions occur directly between the customer and the merchant through the ATH Móvil application.

2. Eligibility

To use PayATH you must:

Have an active Shopify store
Have an active ATH Móvil Business account issued by EVERTEC, Inc.
Be the authorized owner or administrator of both accounts
Agree to and comply with Shopify's Terms of Service and ATH Móvil's terms of service

3. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws. You agree not to:

Use the Service to facilitate fraudulent transactions or misrepresent your business
Attempt to reverse-engineer, decompile, or tamper with any part of the Service
Use the Service in a way that violates Shopify's or EVERTEC's terms of service
Upload content that infringes intellectual property rights or contains malware

4. No Payment Processing

PayATH is strictly a display tool. We do not process, hold, transfer, or settle funds on your behalf. We are not a payment processor, money transmitter, or financial institution. Any disputes regarding payments made via ATH Móvil must be resolved directly with EVERTEC, Inc. and the ATH Móvil Business platform.

5. Intellectual Property

The PayATH app, its code, branding, and all related materials are owned by Musa Studios and protected by applicable intellectual property laws. ATH Móvil® is a registered trademark of EVERTEC, Inc. PayATH is not affiliated with, endorsed by, or sponsored by EVERTEC, Inc. or Popular, Inc.

You retain ownership of any content you upload to the Service (such as QR code images), and you grant us a limited license to store and display that content solely to operate the Service for your store.

6. Availability and Modifications

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We may update these Terms; continued use of the Service after changes are posted constitutes acceptance.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or fit for any particular purpose. Your use of the Service is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Musa Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Musa Studios and its affiliates from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal law of the United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Puerto Rico.
